Shipping and Delivery Terms

Shipment Origin and Arrangements:

Orders typically ship from our main office or another location selected by ColorCopiesUSA.com. When you request shipment, we will arrange delivery services with a third-party carrier on your behalf. The choice of carrier and specific shipping method is at our discretion unless otherwise agreed upon in writing.

Transfer of Risk and Responsibility:

Once your order leaves our facility and is accepted by the carrier, risk and responsibility for the goods transfer to you. From that point forward, the carrier is solely responsible for safely and timely delivering your order. While we strive to select reliable carriers, ColorCopiesUSA.com cannot guarantee their performance and is not liable for any delays, losses, damages, or delivery failures caused by the carrier. We suggest that you discuss with our team when there is a specific in-hand date, so that we can work with you on achieving your needs.

Costs, Duties, and Taxes:

You are responsible for all shipping and handling costs associated with your order. In addition, you are obligated to pay any taxes, customs fees, duties, or related charges that may apply, whether imposed by the carrier, your local government, or a foreign authority. If your shipment is international, you may incur additional import taxes, duties, or brokerage fees not included in your original payment to ColorCopiesUSA.com. Arranging for and covering these fees is solely your responsibility

Addressing Delays, Losses, and Damages:

If your shipment is delayed, lost, or arrives damaged due to carrier error, please notify us as soon as possible. Although we are not financially responsible for the carrier’s failure, we will assist you in working with the carrier to pursue claims, provide necessary documentation, and help facilitate a resolution. Indemnification

By using our services, you agree to indemnify, defend, and hold ColorCopiesUSA.com, Mark V Printing LLC, and our affiliates, officers, business partners, agents, and employees harmless from any claims, demands, or legal actions made by third parties that arise from or relate to Content you submit, provide, or transmit through our website. This includes, but is not limited to, paying any related damages, costs, and reasonable attorneys’ fees.

Intellectual Property and Deliverables

Client's Rights to Final Deliverables

Upon final approval and full payment for the agreed-upon services, the client receives the final, rendered version of the ordered product (“Final Deliverables”). This may include the finished print design, website files (such as compiled code and exported graphics), completed videos, or other final digital outputs. The client’s rights to use these Final Deliverables are subject to the terms and conditions set forth in the applicable agreement or order.

Ownership of Source Materials and Process Files

Unless otherwise agreed upon in a separate, written agreement, ColorCopiesUSA.com (a division of Mark V Printing LLC) maintains full ownership of all source materials, design files, working drafts, original artwork, code repositories, templates, proprietary tools, and any other materials used or created during the production process (“Process Materials”). These Process Materials are not included as part of the final deliverables to the client.

No Automatic Transfer of Underlying Rights:

Except as specifically stated in a separate, written agreement, the client’s acceptance and receipt of the Final Deliverables does not transfer ownership of any underlying copyrights, patents, trademarks, trade secrets, or other intellectual property rights held by ColorCopiesUSA.com. The client does not have a right to the Process Materials or to reproduce, distribute, modify, or create derivative works from the Process Materials without ColorCopiesUSA.com’s express written consent.

Custom Arrangements:

When the client wishes to acquire ownership or additional usage rights to the process materials or other assets beyond the deliverable, such arrangements must be explicitly agreed to in writing prior to the commencement of the project. Additional fees and terms may apply.

Disclaimer and Limitation of Liability

Limited Liability:

In no event shall we be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages of any kind, including but not limited to lost profits, lost revenues, lost savings, lost opportunities, business interruption, or any other economic loss, whether based in contract, tort (including negligence), strict liability, or any other theory of liability, arising out of or related to your use of our services, products, or websites, even if advised of the possibility of such damages. We are not liable for economic damages or any others due to the the work produced or failed to produce, for performance or non-performance

Maximum Liability for Direct Damages:

To the extent that any limitation on liability is found to be unenforceable under applicable law, our maximum aggregate liability to you for any and all claims arising out of or related to our products, services, or performance shall not exceed the amount you paid us for the specific order or service giving rise to the claim. This limitation of liability shall apply to the fullest extent permitted by law.

Right to Refuse Service and Modify Terms

Service and Order Acceptance


Our Company reserves the right, at our sole discretion, to accept, decline, or cancel any order or request for service at any time, for any reason or for no reason at all. We are not obligated to provide an explanation, justification, or alternative solution if we choose not to fulfill an order. In the event that an order is canceled after payment has been processed, we will issue a refund as appropriate to the circumstances.This right is applicable to orders placed by any way of interacting such as web, phone, in-person, mail or other methods.

No Liability for Refusal

By using our services, you agree that Our Company shall not be held liable for any losses, costs, or damages resulting from our decision to refuse or discontinue service. This includes, but is not limited to, any direct, indirect, incidental, consequential, or punitive damages stemming from the refusal of service.

Modifications to Products, Pricing, and Terms:

All information related to our products, pricing, descriptions, delivery terms, production times, and other associated conditions—whether conveyed verbally, displayed at our physical facilities, listed on our website, or communicated through any other medium—is subject to change, discontinuation, or revision at any time, without prior notice. We reserve the right to alter or remove any aspect of our offerings without obtaining the Buyer’s consent or providing advance warning.

Changes in Artwork or Materials Provided by the Client:

If the client elects to submit new or revised artwork, or if the originally provided materials are found to be defective, incomplete, or otherwise unsuitable for production, Our Company may need to adjust previously estimated production and delivery timelines. Any such changes may result in extended production times, later in-hand dates, and potentially additional costs. We will make reasonable efforts to communicate revised timelines as soon as they become evident. The client acknowledges and agrees that Our Company shall not be held responsible for delays or additional expenses resulting from alterations made at the client’s request or due to defects in the materials originally provided.

Our Company reserves the right to provide or refuse service to any customer, individual or corporation, whether the orders are placed in person or through any of our electronic and online platforms without any justification. Our company won't be liable for declining service nor we are required to provide a reason for refusal of service.

 Our prices, products, product descriptions, delivery terms and any other term regarding the information found in writing or verbal within our Company's brick and mortar or online presence can be changed, discontinued or manipulated in any shape or form without previous notice and without acceptance of the Buyer required

Order Cancellation & Artwork Corrections

Cancellation Policy for Custom Orders

All products we produce and sell are custom-made. Once production or preparatory work begins on your order—this includes design, file preparation, pre-press steps, or printing—you can no longer cancel the order or receive a refund. Most online orders move into production immediately upon payment, making cancellation unlikely. If, at our sole discretion, we agree to cancel your order before production starts, we will issue a refund to the original payment method used, minus any non-recoverable transaction fees charged by third-party payment processors.

Requesting a Cancellation

To request a cancellation of an order that you have placed, you must immediately: The fact that the requests are made as instructed does not guarantee that your request will be granted. These steps are needed so that we get the notification. The outcome of your request is not automatically triggered, but subject to consideration.

  • Go to your online portal and request the cancellation of the order from that end as well.

No cancellation request is guaranteed to be granted. The order's production status will determine whether a complete cancellation, a partial cancellation or non at all are possible

Proofs

What to Expect from a Proof

Proofs are intended to help you verify layout, copy and general design before production. Therefore proofs are representations of the product prior to the actual production taking place. On most of the products and services that we provide a proof won't be made with the same equipment or conditions as the final production. A proof is not a final product. It is, as said, a representation meant to review copy, colors, shapes, convenience of use, etc. Most of the production mechanisms utilize inks, varnishes and processes whose results cannot be reproduced in a digitally-submitted proof, nor on a printed proof.

When submitting artwork through our website you are indicating that you are approving the proof. 

Proofs are not provided automatically and for every product or order. If you require an additional proof to the one obtained on the website, you have to specifically ask for it in writing at the time of placing your order. In some instances there are additional fees that you will incur into. 

Resolving Errors in Proofs

  • If you find errors in the proof that arise from files you submitted, you may replace files once at no extra charge. Subsequent file replacements or revisions may incur additional fees.
  • If our creative services are hired, up to two rounds of corrections are included. Additional revisions will incur extra charges. It is your responsibility to provide all necessary guidelines, specifications, and materials upfront. Once our creative team is hired to design your job and the work has started,interrupting or cancelling the order is subject to the next paragraph's terms.
  •  Your job will be moved to production only when as a client you approve a proof in writing, via email or by validating a proof submitted electronically through the colorcopiesusa.com platform. Verbal approvals are not accepted. Once you approve the proof in writing, you assume full responsibility for any overlooked errors such as but not limited to image quality, spelling and others. Our Company is not liable for mistakes, including those introduced by our creative team, if they were present in the proof and approved by you.

Cancellation of an Order for Creative Work: When Our Client hires us for creative work, he/she should submit full copy, images and other specifics related to the project. If the client does not provide the materials and if Our Company is requested to provide them instead, additional fees might be required.

 Should Our Company have started work on project and Our Client decided to cancel the project once the creative process has started, Our Company wil assess the status of progress of the project and charge accordingly. The minimum charge is for one hour of creative service rated at $175.00 per hour (One hundred and seventy five dollars per hour). Additional Fees: Corrections and/or design work may be subject to additional fees. Of course, there is never a charge for any corrections needed as a result of any errors that our creative team introduced in preparing your proof.

Returns and Refunds

Returns

All of the work that Our Company produces is custom-made. Therefore ColorCopiesUSA.com won’t accept returns of printed jobs in exchange for a full or partial refund due to convenience, personal, business reasons or any other reason. Delays by the shipping and transportation companies can't be used to justify the request of a refund, since we don't control those services. We just book transportation on your behalf.

Refunds

Request to cancel orders: If a client requests the cancellation of an order as described above, and authorization of cancellation was granted, our company we will issue a refund to the original payment method used, minus any non-recoverable transaction fees charged by third-party payment processors.

Creative Work: The portion of jobs that involve creative work cannot be returned at all. As described in a previous parragraph, there are minimum charges and an assesment of job completion that the client will still be responsible to pay for. There are guidelines above that indicate how to handle creative work's cost.

Printed Products:  When a client files a complaint for a printed product that Our Company provided, Our Company will make the determination on whether or not the complaint is reasonable and justifiable. Our Company will decide based on the facts if the complaint will be accepted. Should the complaint be considered valid, Our Company will determine in that case if it will reprint a job or issue a refund. The quality of the artwork submitted has a big impact on the final results, therefore every single part of the order has to be evaluated. Your promptness in providing the necessary documentation as requested by Our Company is necessary to resolve cases like this one. Your case can't be assessed nor approved unless the client provides the documentation.

Lost During  Transportation: If the shipper lost a package, you should let Our Company know in a timely way that you have not received a package. Your claim has to be raised on the expected day of arriaval. Not a week later. Not a month later. We provide tracking information for you to monitor the shipping process when you select a shipping method that provides one.

Product Damaged During Transportation: If a package gets damaged during transportation, you must provide immediately proof of the damage: It is required that you submit pictures of the carton, boxes and shipped items from the inside and outisde. You have to provide as detailed pictures that show the box/package in context such as on the floor, on a table, etc. Your pictures must be clear and clean. The damaged materials must be photographed. Not just one sample, but all of the damaged materials must be photographed. You must take pictures of the shipping labels and other documentation that are part of the shipment.

With this information and after evaluation we can process a claim. Once the shipper verifies the validity of the claim for damaged or lost orders by FEDEX ,UPS, or other transportation companies, Our Company will reprint those orders. In case of a claim, Our Company reserves the right to have the buyer return the original order, at our cost, before reprinting or refunding a specific order.

Time Limit for Claims :

  • We won't take complaints for products past 5 (five) days from job pick up or shipping delivery.
  • Claims related do damage during transportation must be placed on the day that the package has been delivered and the documentation requested has to be sent to our team as described above.

    We will not replace an order if it is determined by us that the ordered items were misused or mishandled by the buyer, or if a portion of the order was used by the buye,r and part of the order is being returned. The full order has to be returned.

General

All the terms and conditions and/or any transactions occuring online at www.colorcopiesusa.com, by phone, email, in person, snail mail or other methods are subject to the laws of the State of Florida.  
Machinery breakdowns: ColorCopiesUSA.com is not responsible for the delay and/or damages resulting from Machinery Breakdown, Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo.   
Design tools available on our website: The tools available on colorcopiesusa.com to create document are property of ColorCopiesUSA.com and its affiliated companies.  The Buyer’s order shall be deemed an acceptance of the Seller's terms.  The Terms and conditions shall in all respects be governed by STATE OF FLORIDA law. 

When our company is hired to produce artwork or video or websites or any other form of digital output, Our Client is entitled to the final product or service that Our Company has been hired to provide. Unless there is a previous written agreement as of the terms under which Our Company will provide to Our Client the source files used in the creative process, source files, images nor any block of items used during the creative phase will be released as part of the delivery of the job. The delivery will be limited to the final piece ordered. ColorCopiesUSA.com remains the owner of the creative piece unless a specific agreement in writing has been reached

Reservations - Job Acceptance

All orders are subject to acceptance by ColorCopiesUSA.com. We reserve the right to reject any order at any time without recourse. We also reserve the right to change the price at any time even after we receive the order.

Credit Card and Payment Policies

If the Buyer's credit card is declined, or if any payment made through any accepted payment method is declined or rejected, ColorCopiesUSA.com will not process the Buyer’s order and the order will be "ON HOLD". If the order is shipped and should the Buyer's account become delinquent the Buyer agrees to pay a monthly finance charge of 10% (annual percentage rate of 32%) on the unpaid balance. If an account goes beyond the payment term's due date, unless specific arrangements are made, future purchases will require advance payment. In the event that ColorCopiesUSA.com must commence legal action to enforce any terms of this agreement, the Buyer agrees to pay reasonable legal fees and costs.

Warranty and Quality Assurance

Damaged Shipments:

If your order arrives damaged due to shipping, please contact us promptly—ideally within two (2) business days of receipt. Provide clear photographs of the damage of the box, damage to the products, and pictures of the shipping labels on the box, and all relevant order details. Send us an email to info@colorcopiesusa.com / The subject line should indicate your order number, SHIPPING DAMAGE, and your nanme. Once we confirm that the product was damaged in transit, we will work with you to find a fair and timely solution. This may include reprinting and reshipping at no additional cost, issuing a credit, or offering another mutually acceptable arrangement. Unfortunately the carriers take too long to decide on claims. The more detailed images and information provided, the easier it is. After the referred time, it might be difficult to have the carrier take respoinsibility so if you delay your report, we might not even be able to help you.

Production Errors

If we have produced a product that does not match the specifications confirmed in your approved proof, or if we inadvertently printed the wrong file, please let us know right away. We will review the order details and, if we determine that an error occurred on our end, we will take appropriate action. Depending on the circumstances, this may involve reprinting the item, issuing a partial refund, or granting a credit toward a future purchase. You should document the errors by taking pictures of the product in different parts of the packages, and substantiate the errors potentially made. If you might need a product to be replaced, ColorCopiesUSA might ask you to send the defective products back before making a final decision on the claim. As soon as you pick up or receive your product, promptly send an email to info@colorcopiesusa.com In the subject line refer to the Order Number / Production Error. Include pictures and a clear description of the issue.

Colors and Appearance Variations

Please keep in mind that variations in color, brightness, and appearance can occur due to differences in monitors, screens, and printing equipment. Minor deviations between what you see on your screen and the final printed product are common in the printing industry and are not considered defects. However, if you believe the discrepancy is significant, we will review your claim and, at our discretion, determine if a reprint or partial credit is warranted.

No Exact Color Guarantee

Our processes are designed to produce visually acceptable output but subsequent runs of the same product might result in slight color variations, which does not constitute a reason for a claim. That variation is part of the tollerances for the products that you place an order for our standard products.  Unless explicitly confirmed in a signed, custom order agreement, Our Company cannot guarantee exact color matches or the replication of colors from previous print runs (whether produced by us or by another provider). Minor to moderate color shifts may occur due to inherent differences in inks, substrates, environmental conditions, and equipment calibration. Unless there is grotesque difference between the files submitted and the final output, claims about color accuracy are usually not valid. Different printers, print providers and printing methods produce a color gamut and color impression that is unique to that vendor or equipment, therefore not a variable that is under our control to emulate.

Screen-to-Print Differences: Different devices such as computers, phones, tablets rely on different technologies to show colors. Even the intensity of the light that those devices generate project a diiferent color in itself. Clients acknowledge that what you see on a personal device is for reference only and cannot be used as a guaranteed color representqation.

If your job requires precisd color matching, spot colors, Pantone matching or corporate identity items, you will need to ask for a custom special estimate, submit physical samples and be ready to incur additional fees. A verbal request or a note dropped in an email or in the order won't get you the tight color that you are looking for.

We keep our equipment calibrated and our procedures are such to maintain a very stable and accurate color reproduction, but we provide no guarantees about it.

Liability

ColorCopiesUSA.com will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages, arising out of or resulting from anybody’s performance or nonperformance of our obligations.  ColorCopiesUSA.com shall not be liable to anyone for any kind of financial losses, cost, expenses, damages and/or other economic damages.  The Buyer agrees that the Buyer will not hold ColorCopiesUSA.com responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against ColorCopiesUSA.com and its affiliated company (S) on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person's right to privacy or other personal rights.
